What is Probate?
Probate is the legal process of determining how the property of a deceased person, “decedent,” is transferred to the legal beneficiaries or heirs. The probate process includes determining:
• If a will exists and it is valid
• The decedent’s heirs or beneficiaries
• The value of the decedent’s property
• Resolving the decedent’s financial responsibilities
The final step is transferring the decedent’s property to the heirs or beneficiaries.
The probate process can range from simple to very complex depending on the value of the estate and if it is contested (being fought over).
